Guidelines, Terms and Conditions, General Information and what to expect when you book your installation, purchase a pool or equipment with us! 

 

Please take 10 minutes of your time to read it and address any questions via email so everything is in writing. We have tried to provide and outline as much information as possible. This much information might seem overwhelming; however, this is here to protect you the customer, us, and our employees. We strive for transparency as much as possible. We install above ground, semi in-ground and in-ground pools, so this is a mix for all scenarios.

Communication:  


1.You can text 732-727-3733 or email us at kikipools@gmail.com for faster response and ETA on date of installation. Texts and emails are preferred method of communication as more people see it.  If you are given an afternoon appointment, please be patient as things do not go as planned all the time, summer days are long, and we work late.

 

2. An adult must be always present during the installation process.

 

3. In case of any issues after the installation you need to call us directly, NOT the store you purchased your pool from, they are not responsible for any labor issues. We have been in business for 20 years and try to resolve all issues to the customer satisfaction if possible and as fast as humanly possible.  

 

Disclaimer: 

If you had an estimate in person, some of these might not apply to you. Your estimate will have everything listed less anything unforeseen. However, we cannot simply get to everyone for in person estimate. Pictures of your yard and access to it usually are sufficient for us to estimate any additional charges. 


Here is basic pool install charges that would occur if you booked with us, typically applies to above ground pools:

• Pool installation price - basic filter installation with flex hoses and 3” of level included

• Patio blocks

• Sales tax of 6.625%

• Convenience fee of 3% for credit card payments on amounts over $1500


 Additional Charges That May Occur, Terms and Conditions Associated with it: 

 

1. Materials - Customer is responsible for getting sand delivered or any other materials purchase and delivery. We will provide you with the tons/yards needed for your pool and a local supplier, if we know one, that you can call. We only provide sand and materials for customers local to us.

 

2. Ladder installation is not included due to insurance purposes unless otherwise agreed in advance. The price depends on the type of the ladder. Please check on the price with the seller and the installer ahead of time. You can expect any price between $100 to $400 plus tax.

 

3. Leveling/grading/excavation - included in the base price of our installation is 3 inches of ground leveling. Any grade leveling over 3 inches will cost additional: $50.00 per inch done by machine (Bobcat) and $60 per inch for hand digs and tiller machine. Leveling means that part of the pool will be on grade level and part of the pool will be below grade. There is a difference between leveling and sinking. Sinking/excavating applies to semi in-ground pools, in-ground pools, pools that need to be sunk down to match existing decks, etc. Price varies depending on pool size and access to pool site, please call for pricing. 

 

4. Any extra accessories that you may have purchased with the pool that require complex installation such as, lights, salt systems, solar heaters, gas/electric heaters, decks, fences, PVC plumbing, etc. Example, having a gas heater will incur a PVC Plumbing on our end and you will need to hire a Gas Plumber to run a gas line. 

 

5. Any unforeseen issues such as large roots, stones, missing parts etc. that cause a delay and rental of additional equipment. Example, large stump will require rental of stump grinder and additional labor.

 

6. If you are replacing a liner, the customer is responsible for draining the pool completely prior to the appointment. Any delays due to water in the pool will incur additional charge of $100.

 

7. In case you have a very soft ground, or if the installation is done after rain, not always, we use stone dust in addition to the sand. This is determined on the day of the installation and that will incur an additional labor and material cost.  

 

8. Any manufacturers defect on pool and liner that results in additional visits. For example, seam splits on your liner (most common liner defect) will result in a liner change which will incur 50% charge of our liner replacement fee for the current season. We are not liable for any chemical and water loss. 

 

9. Rental of dumpsters for dirt removal and loading charges.

 

10. Backfill of any semi in-ground pool, in-ground pools, electrical trenches.


11. Any additional visits that are required due to no fault of KiKi Pools. 

 

Access to the Pool Site, Terms and Conditions Associated with it: 

1. To level the ground the installer will use a Bobcat, tiller machine or Excavator, especially for larger pools and severe digs. Our machines require a minimum of a 5' or 6' opening to your pool site, depending on the machine. Semi in-ground and in-ground pools might require a larger opening. Any obstructions must be removed prior to our arrival, fence sections may have to be removed. If we remove a section of a fence, we will put it back to the best of our ability. We are not responsible for any fence damages during the removal process, older wooden and vinyl fence are very brittle and crack easily. 

 

2. We try to keep the yard undisturbed as much as possible, however a machine is going in and out of your yard, in most cases that will cause tire tracks. We would like you to understand that after we are finished you will have some work to do or have a landscaper help you out. We will grade around the pool as much as possible. 

  

General Information, Terms and Conditions Associated with it: 


1. Here are few things we would like you to consider doing before we arrive to install your above ground pool:

• Have a garden hose ready and long enough to reach the pool site

• Pick a site in the yard where you would like the excess grass/dirt to be put or have a tarp laid out

• Have few garbage bags available just in case

• All sprinkler systems need to be shut off a week before install to keep area as dry as possible


2. We are not responsible for bonding (grounding) the pool. THE ELECTRICIAN DOES THIS PART OF THE INSTALLATION. We can do the bonding if previously discussed and agreed on it. We will dig a trench 4” to 6” deep and 18”-24”, by code, away from the pool with a bare copper laid in the trench and bond the pool on either 1 or 4 spots depending on the pool along with water and motor. Bonding trench needs to be 4’’ to 6’’ below final grade, so for semi in-ground and in-ground pools this is done after backfilling is done, not before. If you have your own electrician do the work, please advise them of this. If we are doing the electrical work, none of this applies to you. 


 3. If your installation is postponed due to weather, pool not delivered or any other unforeseen reasons you will be rescheduled for the next available date and NOT next day!!! All work is performed under normal outdoor conditions. We try to accommodate you as quickly as possible, however we are usually pre-booked up to two weeks.

 

4. If you are replacing an existing pool and you have a wooden deck, chances are that the new pool will not fit exactly. This sometimes requires decks to be cut to accommodate the new pool. We are not carpenters and decks will be cut to best of our abilities. You are more than welcome to reschedule your installation and have someone cut your deck properly, however this will result in delays and additional visit charge.

 

5. If you are replacing a pool and we are taking down and hauling away the old pool only metal components will be taken away. We do not have access to plastic and vinyl recycling place. Liner will be cut up and put in garbage bags, all plastic/resin components will be left on premises. Your township can take those and properly dispose of them.

 

6. If you are installing a semi in-ground pool, please make sure you have read all manufacturer suggestions, restrictions, and addendums. This applies to Doughboy pools or any above ground pool that you want to sink into the ground. 

 

7. We are dealing with water connections, hardware, etc. We usually leave before the pool is full of water. Most stores provide a consultation on how to operate/use your equipment.  With that in mind, the occasional leak or drip from those flex hose connections is not uncommon, especially with the rise of temperature and expansion and contraction of flex hoses. We will perform one service call to correct the problem at no charge, however, it might take few days for us to get to you, small drips are not considered an emergency. 


8. All grass, extra dirt and cardboard will be left on the premises. For above ground pool installs usually only grass will be put on the side, dirt will be spread around the pool area. If you have a severe dig or your pool is sunk, you may want to rent a small 10- or 20-yard dumpster for dirt removal, otherwise dirt will be spread around and yard. 


9. All semi in-ground, in-ground pools and electrical trenches require backfill. When dirt is disturbed and put back, natural settling will occur. It’s advisable that all backfill around pools is left to settle on its own for a few weeks before proceeding with any other work. We are not liable for any backfill settling “too much,” especially on electrical trenches, and bringing or adding any additional dirt or soil. 


10. Pool and pool barrier go hand to hand. On above ground pools, you have two options of providing a proper barrier to your pool. Either a compliant ladder with self-closing and self-latching gate or compliant fence either around the pool, or the whole backyard. All gates on fences must open outward and be self-closing self-latching with the latch sitting 52’’ or above. All semi in-ground and in-ground pools need a complaint fence. All pools must be installed behind your house, pools in front and side yards are not permitted. 


11. It is recommended that at least 3’ around the pool is finished/landscaped in a matter that provides almost a maintenance free environment. Any landscape/concrete/ paver work should be done in way that directs water away from the pool. It is not recommended to have grass next the pool, i.e., small stone flying from mower into above ground pool wall will puncture it along with the liner. We are not responsible for such damages. Not finishing around your semi in-ground or in-ground pool will result in water going along the wall of the pool and the backfill settling further and further, this can also undermine the bottom of your pool, cause sink holes and sand wash out. 


12. We do not provide weekly maintenance, nor we deal with any chemicals. Adding chemicals and balancing the pool is customer responsibility. Please refer to your pool dealer for consultation on how to use your equipment.


 PERMITS, FEES, TERMS AND CONDTIONS ASSOCIATED WITH IT:


Permits required for any pool – zoning, building and electrical. For semi in-ground and in-ground a grading plans is needed, engineering might be required. If you have a gas heater a mechanical section will be needed. All heaters must be marked on the electrical permit as well. 


1. Obtaining permits is a joint effort between customers and us. We will provide you with all that is needed to complete the building and electrical (if booked with us) portion of the permit. Customer is responsible for filling for zoning permits, as those are different for every town. Survey of the house is required to complete the zoning application. Pool must be drawn by customer, by hand, on the survey showing the distance from rear and back property line. If your town requires a ''to scale" survey, you can email a PDF copy to us, and our engineer will draw it to scale. $100 charge will occur. Surveys must be up to date, if you are missing structures on your survey, please email one copy of your survey with all structures and dimensions drawn on it along with a clean survey so we can transfer all the structures digitally to scale.


 2. The customer is responsible for calling and scheduling final inspections for both building and electric work and getting the receipt of the final inspection. Failure to do so will result in an open permit. Most towns have online scheduling available, or you can email/call the construction department. An adult must be present at all township inspections.  All sticker of passed or rejected inspection must be kept by customer and emailed or texted to us. All inspections must be passed in the year the pool is installed; we are not liable for open permits past the year of installation. 

 

3. The customer needs to contact us within 48 hours after paying permit fees and picking up permit package from township to schedule or reschedule installation appointment. Depending on the time of year and township, it will take anywhere from 3-6 weeks to get your permits submitted and approved. 


4. KiKi Pools is only liable for the work we have performed and will fix any issues the town might have related to that work alone. Customer is responsible for any violations issued for any other reason and agrees to fix those to close the permit. Customer is responsible for all permit fees associated with the permit. 


5. Customer agrees to close the permit in no more than 45 days after install is completed. After the 45-day period the customer agrees that any balance left will be paid to KiKi Pools, regardless of permit status. Customer agrees not to withhold final payment to KiKi Pools if the permit is not closed due to but not limited to other parties involved such as electricians, plumbers, etc. 


TERMS AND CONDITIONS 

ALL INSTALLATION WORK AND LABOR IS GUARANTEED FOR A PERIOD OF NINETY (90) DAYS.  ALL CLAIMS OF DEFECT INCLUDING MANUFACTURING DEFECTS REGARDING PRODUCTS AND POOL’S COMPONENTS ARE SOLELY THE RESPONSIBILITY OF THE POOL MANUFACTURER. LAWN DAMAGES DONE BY OUR EXCAVATORS ENTERING AND EXITING THE PROPERTY ARE CUSTOMER’S RESPONSIBILITY. POOL SURROUNDINGS ARE ALSO NOT OUR RESPONSIBILITY. YOU HEREBY AGREE THAT ALL CONTROVERSIES THAT MAY ARISE RELATING TO THIS AGREEMENT SHALL BE DETERMINED BY ARBITRATION CONDUCTED IN NEW JERSEY ACCORDING TO THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION. YOU AGREE AND ACKNOWLEDGE THAT: (I) THE DECISION OF THE ARBITRATOR(S) SHALL BE FINAL AND BINDING AND (II) ANY JUDGMENT UPON THE AWARD OF THE ARBITRATOR(S) MAY BE ENTERED IN ANY STATE OR FEDERAL COURT HAVING PROPER JURISDICTION. TO PASS FINAL INSPECTION YOU MUST COMPLY WITH ALL TOWNSHIP CODES. WE RESERVE THE RIGHT TO REFUSE OR CANCEL INSTALLATION AT ANY TIME, IN SUCH AN EVENT ALL FEES WILL BE RETURNED. RACIAL DISCRIMINATION, IMPROPER CONDUCT OR YELLING AT OUR EMPLOYEES WILL RESULT IN IMMEDIATE TERMINATION OF CONTRACT, NO FEES WILL BE REFUNDED AND NO FUTHER SERVICE OF ANY KIND WILL BE PERFORMED. ANY PAST DUE AMOUNTS/OUTSTANDING BALANCES ARE SUBJECT TO THE MAXIMUM RATES OF INTEREST PERMITTED BY THE LAW AND WILL BE ACURED DAILY. ALL RETURNED CHECKS ARE SUBJECT TO ONE TIME $30 PENALTY FEE IN ADDITION TO ANY OTHER COST INCLUDED. CUSTOMERS AGREES THAT ALL COMUNICATION BETWEEN US, INCLUDING BUT NOT LIMITED TO EMAILS, TEXTS, PHONE CALLS IS PRIVATE AND WILL NOT BE POSTED ONLINE OR FORWARDED TO OTHER PARTIES WITHOUT OUR CONSENT. 


PLEASE NOTE THE FOLLOWING IMPORTANT WARNINGS:

• DO NOT DIVE OR PERMIT DIVING OR JUMPING INTO THE POOL!

• DO NOT PERMIT “ROUGH HOUSING” IN AND AROUND YOUR POOL!

 • DO NOT WALK ON TOP RAIL OF POOL, IT IS NOT A WALKWAY!

 • POOL MUST BE BACKFILLED ONLY AFTER THE POOL IS PROPERLY FILLED IN ORDER TO PREVENT BENDING OF THE WALLS AND/OR SAND WASHOUT!

  

WE AT KIKI POOL INSTALLATIONS, LLC ARE NOT RESPONSIBLE FOR THE FOLLOWING, UNLESS OTHERWISE SPECIFICALLY AGREED TO PREVIOUSLY IN WRITING:

• Backfilling the pool 

• Removal of boxes, excess grass, stone, or dirt that might work up, as a result of the installation

• Grounding or bonding of the pool

• Water supply 

• Ladder assembly and installation

• Any undisclosed utilities, such as gas lines, electrical wires, sprinkler systems, etc.

• Any damages done by other parties involved in the process such as sand delivery, dumpster delivery or any other service not provided by us

• Any sink holes, sand wash out including but not limited to ground hogs, improper/missing landscape around pool, or any other reason that is not our fault

• Adding of any chemicals or balancing pool chemistry

• Any water or chemical loss due to a liner defect (i.e., a broken seam) 

• Any fence around pool or property not meeting township requirements 

• Any retaining wall that might have to be build due to severe slope



ELECTRICAL WORK, FEES, TERMS AND CONDITIONS ASSOSIATED WITH IT: 


All electrical work is performed by Petroff Electric, its employees and KiKi Pools employees. All work is subject to KiKi Pools terms and conditions. All work is guaranteed for a period of 90 days. We agree to replace any faulty device limited to breakers, timers, and outlets one time free of charge in the first year after install. All work after that will be charged at current rates. Please be mindful that we are dealing with water and electricity. Please check your GFCI devices regularly to ensure proper protection is provided. We are not liable for any malfunction of any device and any injury resulting from it. 


Payment Terms - Installation Only: 

All amounts, minus any deposits, due must be paid in cash, check or credit card right after the installation is done. Returned checks are subject to $30 penalty fee in additional to any other costs incurred. Please do not postdate checks as they are deposited daily. Any past due amounts/outstanding balances are subject to the maximum rates of interest permitted by law and will be accrued daily.


Cancellation Terms - Installation Only: 

-Customer must cancel their installation appointment by phone or email no less than 14 days prior the installation date. You agree to forfeit you deposit without dispute after that.

- If you receive a refund of any payment made on a credit card you agree to pay/deduct 4% processing fee. 



POOL PURCHASE/SALES TERMS


If your sale is above $500 and involves a home improvement as defined by N.J.A.C. 13:45A – 17.2 and N.J.S.A. 56:8-137. You are being provided with the following notice: 


NOTICE TO CONSUMER: 


YOU MAY CANCEL THIS CONTRACT AT ANY TIME BEFORE MIDNIGHT OF THE THIRD BUSINESS DAY AFTER RECEIVING A COPY OF THIS CONTRACT, YOU MUST EITHER: 


1. SEND A SIGNED AND DATED WRITTEN NOTICE OF CANCELLATION BY CERTIFED MAIL RETURN REQUEST RECEIPT OR 

2. PERSONALLY DELIVER IT TO KIKI POOLS 12 ADAM BLVD, SOUTH AMBOY, NJ 08879 OR

3. EMAIL IT AND PHONE US TO MAKE SURE WE HAVE RECEIVED IT


If you cancel this contract within 3 days, you are entitled to a full refund of your money. Refunds must be made withing 30 days of the contractor’s receipt of the cancellation notice.


Any changes to this contract must be in writing, signed by you and KiKi Pools and is subject to the cancellation provisions above if applicable. 

 

Delays, in delivering the product or service, beyond KiKi Pools estimated date due to manufacturer’s delay is out of KiKi Pools control and it is not a valid reason for cancellation or refund. You agree to wait until your product or service arrives no matter how long it takes to come in. If you cancel your contract you agree to forfeit your deposit without dispute. 


The product is provided “as is” and with all faults. KiKi Pools does not provide additional warranties of any kind whatsoever. All warranties are only through the manufacturer. Customer agrees to waive all claims against Kiki pools and its representatives arising or resulting from the use of the product. Kiki Pools will act as a warranty station to serve our customers when allowed by the manufacturers. All manufacturers’ warranties are available for review upon request. Failure to install, use, and maintain your pool in accordance with the manufacturer's instructions will void all warranties 


If you fail to pay for your purchase after delivery by any means including but not limited to insufficient funds, stopped payment or credit card charge back, you agreed to pay all collection costs including legal fees to collect any amounts owed plus court cost at the maximum interest allowed by law. Purchasing an item, keeping it and not paying for is a criminal offence and, in some cases, KiKi Pools will protect their rights by pursuing a criminal complaint.


All purchases are subject to KiKi Pools management approval and KiKi Pools refund policy, which starts with customer deposits, not receipt of goods. You agree that no verbal commitments have been made other than what is written on this invoice. Upon delivery this sale is considered complete and in acceptable condition unless noted on delivery receipt. Any questions or feedback, please contact us at kikipools@gmail.com or 732-727-3733.


Payment Terms on Sales: 

- We accept payments on delivery of pools 

- Credit Card Payment can be made in person, over the phone or online. 

- Cash and certified(bank) checks are acceptable upon delivery of pools and products

- All deposits are non-refundable after the 3rd day of date signed 

- If you receive a refund of a payment made on a credit card you agree to pay/deduct 4% processing fee


Customers agree to accept delivery of product within three weeks of our receiving regardless of timing. If products have not been paid in full for in advance and customers refuses to pay for product on the day of delivery, customers agrees that all products will be taken back, this contract will be void, all deposits will be forfeit without dispute. We cannot store the product over the winter or extended time. If you wish to store your product over the winter, you will be charged a storage fee.
